Terms and Conditions
For The Den Gym South Africa (The Den), owned and operated by The Greatest of All Time TA The Den Gym on Club St, Sandringham, Johannesburg, 2192, South Africa.
By completing and submitting the application/registration form (online or offline), you agree to be bound by these terms and conditions, whether for yourself or on behalf of a minor if registering for a minor. You confirm that you are at least 18 years old or, if signing on behalf of a minor, that you are their parent/legal guardian and accept full responsibility for their participation.
These terms govern the use of The Den’s facilities, training services, and website (www.thedengym.co.za), including any information services provided.
If registering for a minor, it is your responsibility to ensure they understand and comply with these terms.
1. Health & Safety Conditions
1.1 Physical and Mental Condition
Engaging in exercise and training can be physically strenuous and carries inherent risks, including accidents, injury, or illness. You acknowledge that it is your responsibility to consult a healthcare professional before engaging in any training, especially if you have any existing medical conditions or concerns.
By registering with The Den, you confirm that you have no known medical conditions preventing safe participation. If your health condition changes, you agree to seek medical advice and inform The Den in writing.
1.2 Assumption of Risk
You voluntarily assume all risks related to participation in training and acknowledge that The Den is not responsible for injuries, illnesses, or other health-related issues that arise from your participation.
1.3 Gym Etiquette & Conduct
To maintain a safe and respectful environment, all members must:
- Treat all members, staff, guests and spectators with respect and without prejudice or bias.
- Follow instructions from coaches and staff for safety and training purposes.
- Take care of the equipment and return it after use.
- Refrain from disruptive or offensive behaviour.
- Not use illegal drugs, consume alcohol excessively or use banned substances on gym premises.
- Adhere to hygiene protocols, including cleaning equipment after use.
Failure to follow these rules may result in immediate suspension or termination of membership.
2. Membership Terms
2.1 Membership Types
Memberships are subject to these terms and may be updated periodically. Memberships are not transferable to another person unless explicitly allowed by The Den.
Challenge Memberships:
- Membership for specific fitness challenges starts on the Contract Start Date and ends after the challenge.
- Challenge membership fees must be paid in full before the challenge begins.
Contract Memberships:
- Membership begins on the First Payment Date and continues on a monthly recurring basis until cancelled with written notice.
2.2 Cancellation
- Members must provide 2 months’ written notice via email to hello@thedengym.co.za to cancel their contract.
- The final two monthly payments remain due after the cancellation notice is given.
2.3 Termination of Membership
The Den Gym reserves the right to terminate or refuse membership for:
- Failure to pay fees on time.
- Providing false or misleading information during registration.
- Misconduct, damage to property, or failure to follow gym policies.
- Any behaviour deemed harmful or disruptive to the gym, staff, or members.
If terminated due to misconduct, fees will not be refunded.
2.4 Membership Freeze Option
Members may request to freeze their membership for a period of up to 3 consecutive months due to medical reasons, extended travel, or other valid personal circumstances.
- A written request must be submitted to hello@thedengym.co.za at least 14 days before the freeze period begins.
- The freeze is subject to approval and may require supporting documentation (e.g., medical certificate, travel documents).
- Membership payments will be paused during the freeze period, and the membership will be extended accordingly.
- Freezing a membership does not waive any outstanding payments due before the freeze request.
2.5 Discretionary Reduced Rates
The Den may, at its sole discretion, offer members a reduced membership rate for up to 6 months under exceptional circumstances, including financial hardship or other valid reasons.
- Requests for reduced rates must be submitted in writing to hello@thedengym.co.za with a detailed explanation of the reason for the request.
- The gym reserves the right to approve, deny, or determine the duration and percentage of any discount offered.
- Any reduction granted is temporary and does not affect future pricing or membership obligations.
- If approved, the member agrees that rates will return to standard pricing at the end of the agreed period unless otherwise extended by The Den.
3. Fees & Payments
- Membership fees for contract members are due monthly in advance on the 1st of each month.
- Late payments beyond 7 working days will incur a 5% late fee.
- Members paying via direct debit must complete the required payment authorization forms.
- Challenge membership fees are non-refundable once the challenge begins.
- Membership fees are non-refundable, except where required by law.
The Den reserves the right to increase membership fees with 30 days’ notice.
Failure to pay fees may result in suspension or termination of membership and outstanding fees may be sent for debt collection.
4. Facilities & Services
- The Den reserves the right to modify training schedules, equipment, and services as needed.
- Members must arrive on time for sessions. Late arrivals may be denied entry.
- The gym is not liable for temporary closures due to maintenance, public holidays, or events.
5. Liability & Indemnity
- Members acknowledge that participation in physical training involves risks and release The Den from any claims related to injuries, accidents, or health issues.
- Members waive the right to sue The Den, its owners, staff, or affiliates, except in cases of gross negligence.
- Members accept full responsibility for their own training choices and agree to seek medical advice if needed.
- Parents/guardians signing for minors accept full responsibility for their participation.
6. Loss & Damage to Property
- The Den is not liable for lost, stolen, or damaged personal belongings, including vehicles parked on the premises.
- Members are responsible for any damages they cause to gym property and may be charged for repairs.
7. Privacy & Data Protection
7.1 Personal Information Collection
- The Den collects personal data only for registration, payment processing, and gym operations.
- Sensitive information (e.g., health details) will not be shared publicly without consent.
7.2 Photo & Video Content
- Members consent to be included in photos or videos taken at The Den for promotional purposes.
- Members who wish to opt out of promotional content must provide written notice.
8. Changes to Terms
- The Den may update these terms from time to time.
- Members will be notified of any material changes.
9. Severability & Governing Law
- If any part of these terms is found unenforceable, the remainder remains in full effect.
- These terms are governed by South African law.
10. Acknowledgment & Agreement
By registering with The Den, you acknowledge that you:
Release The Den Gym South Africa from liability except in cases of gross negligence.
Have read, understood, and agreed to these Terms & Conditions.
Assume full responsibility for your health, safety, and participation.
Accept the membership payment and cancellation policies.
