WAIVER AND RELEASE OF LIABILITY

I acknowledge that participation in physical exercise and training involves inherent risks, including but not limited to serious injury, illness, accidents, and potential long-term health effects. I confirm that I am voluntarily engaging in training and exercise at The Den at my own risk and that I am physically and mentally fit to do so. I understand that I should consult a medical professional before participating in any exercise program or using any gym equipment.

ASSUMPTION OF RISK

I understand that training at The Den may include, but is not limited to, the following risks:

  • Muscle strains, sprains, and fractures due to weightlifting and high-intensity exercise.
  • Cardiovascular strain or complications from high-intensity training.
  • Accidents involving gym equipment, including improper use or mechanical failure.
  • Worsening of pre-existing medical conditions if not disclosed to my physician or the gym staff.
  • Injuries resulting from failure to follow instructions or improper use of equipment.

By signing this waiver, I assume full responsibility for any injury or harm that may result from my participation.

WAIVER AND RELEASE OF LIABILITY

To the fullest extent permitted by South African law, I hereby waive, release, and discharge The Den, its owners, trainers, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action related to any injury, illness, death, or damage to property that may occur while participating in training, classes, programs, or events at the facility. This waiver applies even if the injury arises from ordinary negligence but does not extend to gross negligence, reckless conduct, or willful misconduct by The Den Gym South Africa or its staff.

MEDICAL EMERGENCY POLICY

I acknowledge that in the event of a medical emergency, The Den staff may provide immediate assistance or contact emergency medical services. I accept that any medical expenses incurred will be my sole responsibility and that The Den Gym South Africa assumes no liability for the cost or outcome of any medical treatment.

PERSONAL PROPERTY

I understand that The Den is not responsible for the loss, theft, or damage of personal property while on the premises.

MEDIA CONSENT

I grant The Den permission to use photos or videos taken of me during training sessions for marketing and promotional purposes. If I do not consent, I will notify the gym staff in writing before participation.

SEVERABILITY

If any part of this waiver is deemed unenforceable by a court of law, the remaining provisions shall remain in full effect.

By signing below, I acknowledge that I have read and understood this waiver. I voluntarily agree to its terms and confirm that this agreement cannot be modified orally.
